§1 - Provider
(1) Operator and provider of the online portals (www.get2card.de, www.get2App.de, www.worldfor2.de including the get2Card and get2App is World for 2 Verlags GmbH, 13467 Berlin, Mühlenfeldstr. 2, Tel 030 4380980, info@get2card.de. The contract is concluded with the above mentioned GmbH.
(2) These general terms and conditions apply to all contracts concerning the conclusion and use of get2card via this website. Any terms and conditions of the customer shall not apply.

§2 - Services of the provider
(1) The owner of a get2Card/get2App can take advantage of discounts from the partners participating in the get2 program during the term of the card. For this purpose, the Partner grants the Cardholder a discount in the form that one offer is used by two persons, but only the price for one person is charged ("2for1"). During the term of his card, 2for1 discounts are fully available to the cardholder in the specified categories. The offers are published in the Guide and on the Internet and in get2App. The partners and their offers can change within the respective area. (2) The get2Card is available in various variants at the customer's option: as a printed card in credit card format, as a photo on the display of the digital app for use on a smartphone or other mobile device. Paragraph 1 applies to all these product variants (hereinafter also referred to as "cards" or "card").
(3) In addition, all customers may make use of certain further offers (offers requiring reservation, also referred to as "loyalty offers") which are special promotions limited in time or number of participants. The details can be found in the description of the respective offer subject to reservation. The reservation confirmation as well as vouchers, which are awarded in competitions, are automatically forwarded to the respective offer partner with the name, get2Card number, telephone number and e-mail address and are only used for the purpose of the booking.
(4) In order to use the offers, the Customer must present his card to the Partner prior to making use of the offer or - in the case of the digital app - show it on the display. All cards - including the digital app - are bound to the respective cardholder and cannot be transferred to third parties. If you uploaded your own profile photo in the get2App, you don't need a photo ID. The profile photo is used exclusively for display on the card.
(5) The get2Card will be accompanied by a list of offers (guide) and/or digital Guide by post. The get2Guide will be reissued at least once a year. With the publication of a new guide, all offers from the expired guide lose their validity. All information and offers in the respective guide and/or digital Guide are based on information provided by the advertising partners (system partners). The holder of the Card shall only have a claim to performance of services and any liability claim against the respective system partner. World for 2 Verlags GmbH assumes no liability for non-compliance and defects in the offer as well as verbal promises by sellers that deviate from the statements of the guide and do not conform to the GTC. The latest changes to the respective offer are published on the Internet at www.get2card.de/Guideänderung .
§3 - Regulations for printed get2card subscriptions
(1) With this card type, the provider issues the get2card as a printed card in cheque card format and sends it to the customer together with the current get2-Guide by post and/or digital Guide.
(2) The customer can choose to pay for the card by SEPA direct debit, bank transfer, PayPal, instant transfer, credit card or cash. The payment period shall be two weeks from receipt of the confirmation of contract.
(3) The customer shall receive the card by post within 5 working days of conclusion of the contract. This does not apply if the customer has selected cash payment; in this case, the customer can collect the card from the provider's registered office for cash payment from the time the contract is concluded.
(4) The initial contract period for the get2Card is one year. The contract period shall be extended by one year at a time as long as neither party terminates the contract by giving six weeks' notice to the end of the contract period. The card and the invoice for the following year will be sent to the customer by post approximately two weeks before the start of the year. For the payment of the invoice, the payment method last chosen by the customer shall be deemed to have been agreed. If the previously debited account has expired in the meantime and we are not aware of a new account connection, the payment method will be changed to invoice with costs. For the transmission of the respective follow-up card and invoice, the customer is obliged to inform the provider immediately of any change of postal address. The costs incurred in this connection, such as postage and enquiries to the residents' registration office, shall be borne by the customer.
(5) If the card is a gift card for a third party, the initial term of the contract shall not be extended.
(6) The right to termination without notice for good cause remains unaffected for either party. In the event of termination with effect before the expiry date printed on the Card, the Customer shall be obliged to return the Card to the Provider; the costs of returning the Card shall be borne by the Customer, unless the Customer is not responsible for the termination.
(7) Any notice of termination must be in text form in order to be effective.
§4 - Rules for the get2ristCard (get2Card for Tourists)
(1) This card type can only be used with the get2App and a Smartphone or Tablet. The get2App can be downloaded free of charge from the Apple Appstore and Google Playstore.
(2) The customer can order a card printed by the provider in cheque card format as an additional chargeable service. The customer will receive this card within 5 working days of conclusion of the contract together with the current offer guide (get2-Guide) and/or digital Guide by post. This does not apply if the Customer has selected cash payment; in this case, the Customer may collect the card against cash payment from the registered office of the Provider from the time the contract is concluded.
(3) The customer may choose to pay for the card by SEPA direct debit, PayPal or credit card. The payment period is two weeks from receipt of the confirmation of contract.
(4) The term for the get2ristCard can be found at www.get2card.de .
(5) § 3 paragraphs 6-7 (termination) apply to get2riCard accordingly.
§5 - Regulations for get2App
(1) With this type of card, the customer can use the services according to § 2 via a digital app instead of a printed card. The prerequisite is that the customer uses a mobile device (e.g. smartphone, tablet) on which the get2App is installed. get2App runs on all devices with iOS operating systems (Apple) or Android operating systems (Google). get2App is available for free download on the App Store (Apple) and Play Store (Google) for these devices. For the data connection during the download, the Customer's network operator may charge connection fees over which the Provider has no control.
(2) After conclusion of a paid contract for one of the product variants (get2Card in annual subscription, get2ristCard, get2App alone or monthly subscription digital Flexible), the Customer shall immediately receive an activation code from the Provider by e-mail with which the Customer can activate the Card/App.
(3) If the Customer receives the activation code for get2App as a free supplement to a printed or printable card, get2App will be valid for the same period of time as the underlying card. Otherwise, the following paragraphs shall apply to the term and extension.
(4) The initial contract period for get2App is one year. The contract term is extended by one year at a time as long as neither party terminates the contract by giving six weeks' notice to the end of the contract term. The same conditions of § 3.4 apply to the payment of the invoice.
get2Digital Flexibel (monthly subscription) has a minimum term of 3 months, after which it is automatically extended by a further month, unless it is terminated in writing at the latest 7 days before the end of the term.
(5) The right to termination without notice for good cause shall remain unaffected for each party.
(6) Any notice of termination must be in text form in order to be effective.
§6 - Replacement in the event of card loss
(1) If the customer can prove the loss of a get2Card, get2ristCard or get2digital printed by the provider, which can be displayed on the smartphone, by presenting a police report of loss or theft, the provider will issue the customer with a free replacement card.
(2) If the customer insures the loss of a get2card, get2ristCard or get2digital printed by the provider without presenting a police loss or theft report, the customer can order a replacement card at a price of 10 euros including 19% VAT.
(3) If the card is a gift card for a third party, paragraphs 1-2 shall apply mutatis mutandis to the third party receiving the gift.
§7 - Order and conclusion of contract
(1) The order is placed via the provider's website. After entering the desired card type, the personal data of the customer and the payment method, the customer can send his order request to the provider by clicking on the button "order with payment" or "buy". The orderer has the possibility to view and change the data given in the context of the order or to cancel the order completely at any time up to the dispatch of his order desire.
(2) The services listed on the provider's website represent a binding contractual offer to the customer. By sending the order request via the button "order with payment" or "buy" the customer accepts the offer, whereby the contract is concluded. The provider confirms the conclusion of the contract immediately by e-mail (confirmation of contract).
(3) The content of the concluded contract is stored electronically by the provider and transmitted to the customer in the contract confirmation. It is recommended that the customer retain the confirmation of contract, as it is not possible for the customer to inspect the stored data beyond this. In addition, the provider keeps the customer file in electronic form. The customer must ensure that his submitted paper documents are destroyed after they have been converted to electronic form, they are shredded in accordance with the DSGVO.
(4) The selection of the service, the conclusion of the contract and the execution of the contract shall be made exclusively in the German language.
§8 - Price quotations, costs for direct debits not redeemed
(1) All prices quoted are final prices including 19% VAT.
(2) If the customer has chosen direct debit as the method of payment and a direct debit submitted by the provider after the due date is rejected, the customer shall bear the associated costs, unless the customer is not responsible for the non-redemption.
§9 - Consumer Right of Withdrawal
(1) A customer who orders as a consumer is entitled to a right of revocation in accordance with the statutory conditions. A consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor his self-employed professional activity.
§10 - Declaration of consent for establishing contact
The customer agrees that World for 2 Publishers or its sub-authorities may contact him by telephone, fax or e-mail for the purpose of support and possible product additions or changes. This consent may be revoked in whole or in part at any time by the customer in writing, with effect for the future.
§11 - Privacy policy
(1) The provider collects the name, address and e-mail address of the customer in the context of his order. Insofar as the customer voluntarily provides supplementary data in the context of his order (e.g. a different delivery address, a telephone number or the personal data of the recipient for a card ordered as a gift), these shall also be collected.
(2) If the customer chooses SEPA direct debit as the payment method, the provider shall also collect the customer's bank details (IBAN, BIC). If the customer uses the services of external payment service providers such as PayPal, Sofortüberweisung (Klarna) or credit card for the payment process, the respective data protection regulations of the payment service provider also apply for the payment process. PayPal, Klarna, credit card will act as vicarious agents of the customer, not of the provider.
(3) The provider processes the collected data in his computer system for the proper fulfilment of the contract, in particular for the dispatch, invoicing and booking of payments. For the purpose of shipping, the provider may also transmit the name and address of the recipient to the commissioned shipping company.
(4) The provider keeps the data stored until all mutual claims from the contractual relationship are completely settled and the commercial and tax retention obligations for the provider have expired.
(5) The customer can demand information from the provider about the data he has stored about the customer at any time. Furthermore, the customer may demand the correction of erroneous data at any time. In the case of a gift card, these rights also apply to the recipient.
(6) The provider named in § 1 paragraph 1 is responsible for data protection.
§ 12 - General Terms and Conditions for Participating in Prize Draw Games

(3) Eligibility
Eligible to participate are persons resident in Germany who are at least 18 years old at the time of participation.

The winners of the prizes will be determined among the participants by drawing lots after the closing date for entries and will then be notified by e-mail and/or post.
Legal recourse is excluded. A cash payment or exchange of the prize is not possible. If the winner does not respond within 14 days of notification, the claim to the prize will lapse and a substitute winner will be drawn according to the same procedure.
If tickets for short-term events are raffled, the participants will be notified by e-mail or telephone.
The above-mentioned claim of 14 days does not apply in such cases due to time constraints.

(7) Other
World for 2 Verlags GmbH reserves the right to suspend any or all of the games in the event of any difficulties that jeopardize the integrity of the game.
§13 - Final provisions
(1) Warranty law shall be governed by the statutory provisions.
(2) The law of the Federal Republic of Germany shall apply to the exclusion of the conflict-of-law provisions of international private law; this choice of law shall not apply insofar as it would restrict the legally mandatory rights of a consumer with permanent residence outside Germany.
(3) Should individual provisions of these General Terms and Conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
